As with all criminal motions, typically case specific. But this does have applicable mistake of law citations. Used to good effect: not litigated, but DA dismissed the case within days of receiving the motion. Huge victory for defendant, who faced mandatory jail time for what would have been his 5th driving under revocation (and the most recent was for an alcohol offense).
