A motion we filed to dismiss one of the criminal counts due to the failure of the court to have a preliminary hearing. at hearing Defendant requested a preliminary hearing, however the State argued against it saying the Defendant was not entitled. court agreed. Supreme court ruled that Defendants were entitled and therefore we requested a dismissal.
