Common types of Civil Litigation

Many types of legal disputes fall under civil litigation. In most cases, they involve money or property but that’s not always true. Sometimes the parties involved may simply want action from the other party and need the courts to help enforce that. For example, if neighbors have a property disagreement or a tenant and landlord have a dispute those would be considered civil litigations. Other common types are

  • Personal injury
  • Car accidents
  • Workers’ compensation
  • Semi-truck accidents
  • Wrongful death cases

As a general rule, civil litigation refers to any legal proceeding without criminal charges or penalties. They are also very common. The outcome of a criminal trial could end with a person being incarcerated. This is a legal process of resolving a dispute between two or more parties ( an individual or business) who seek compensation usually in the form of money. They can also be for damages or a specific performance that was not met.

Civil proceedings are held to a lower standard when it comes to proof than criminal cases. Attorneys must provide the evidence and present a solid and much more convincing case than their opponents. They can help you gather all the right documents and additional proof you need for the case. The type of civil case you pursue will depend on the circumstances of your case. Apart from trials, litigation lawyers represent their clients in other types of proceedings. Attorneys may advocate for their clients at pretrial hearings, depositions, arbitrations, or mediations.

Another important thing that you have to consider when involved in a civil case is the statute of limitations. This is when you have a set amount of time outlined for legal action to be taken. There are many variations of limitation depending on what type of case you are involved in as well as the parties involved. To present a strong case that is backed by clear evidence and achieve a positive verdict, you need to choose a skilled and qualified attorney as soon as possible. Individuals, businesses, and corporations can all be represented by a civil litigator.
