Motion to preclude the Government from seeking the death penalty against a Defendant who was suffering from severe mental illness at the time the subjected crime was committed. Act of subjecting said Defendant would violate the Eighth Amendment of the United States Consitution.

Motion to preclude the Government from seeking the death penalty against a Defendant who has a reduced mental capacity due to living with fetal alcohol syndrome. The defense will go into detail how fetal alcohol syndrome had an effect on the Defendant’s mental capacity at the time of the said committed crime, justifying for a lesser sentence.  Act of subjecting said Defendant would violate the Eighth Amendment of the United States Consitution.
