Description
Motion to Suppress Warrantless Entry: Pre-Trial Motion to suppress evidence and/or an arrest based upon a warrantless entry into a residence. No exigency or welfare issue either, though the officer in this case attempted to claim “consent” to enter because the defendant’s girlfriend opened the door. Motion was successful in that the District Attorney dismissed the case upon filing and before the issue was litigated.
